❖Envio de cartão de crédito não solicitado é prática abusiva sujeita a indenização.⠀
A Corte Especial do STJ aprovou a súmula 532, para estabelecer que “constitui prática comercial abusiva o envio de cartão de crédito sem prévia e expressa solicitação do consumidor, configurando-se ato ilícito indenizável e sujeito à aplicação de multa administrativa”.⠀
A súmula tem amparo no artigo 39, III, do CDC, que proíbe o fornecedor de enviar produtos ou prestar serviços sem solicitação prévia.⠀
Um dos precedentes que levaram à edição da nova súmula é o REsp 1.261.513. Naquele caso, a consumidora havia pedido um cartão de débito, mas recebeu um cartão múltiplo. O Banco Santander alegou que a função crédito estava inativa, mas isso não evitou que fosse condenado a pagar multa de R$ 158.240,00.⠀
Para o relator do caso, ministro Mauro Campbell Marques, o simples envio do cartão de crédito sem pedido expresso do consumidor configura prática abusiva, independentemente de bloqueio.⠀

I’m considering getting a credit card to..... increase the interest on my high interest savings account. Buuut I’m not sure if it’s worth it and would love to hear your opinions, experiences, and pros & cons. I’m not the best at math so haven’t entirely weighed up the benefit but the idea is that I keep my pay in my high interest account and for all purchases use a credit card until the credit card bill is due. Essentially:
- I’m pretty good at living within my means so should be able to trust myself not to splurge “just because I have a credit card”
- I’ve never been in ‘consumer debt’ but am still a tiny bit concerned I won’t keep a close enough eye on my spending as I do with my eftpos card
- My savings account has a 1.95% interest rate if I transfer a minimum of $1000 per month (currently do this)
- I don’t get penalties for taking money out of my savings so paying my credit card bill wouldn’t ‘disadvantage me’ in terms of interest
- I’ve done some basic research and believe my bank (ING) offer a credit card with a 45 day billing period and no annual fees
So what possibly could the cons be? (Other than ending up in proper debt if I don’t closely watch what I’m spending). Open to comments and messages on any thoughts, opinions and / or knowledge you have on credit cards! 💰💸💳

Finally getting around to a further wardrobe clean out and posting some stuff for sale - I know I need to work on my photo game but right now I just don’t have the energy to put into it. I use Facebook to sell - I’ve not had much luck with eBay or Depop but I wasn’t very committed to them either. I’m hoping to sell as much as I can in the next few weeks because I’m going to have to move my clothes to my brothers house because my aunt is visiting from England and my clothes currently live in the spare room. The only reason you would not use debt is because you do not trust yourself! 💯
The #1 rule is to NOT buy things and stuff with money that you don’t have. That is what consumers do.
We use debt to:
1) scale business
2) provide a margin of safety
3) make investments (buying companies or real estate)
4) to get out of debt ...
yes I have used debt for all of those things including the use of debt to get out of debt 🤯
