What exactly is GUARDIANSHIP? It is the legal authority granted by a court over a child and/or the child’s property. While a child’s biological parent can step in and become the legal guardian, another family member or God parent CANNOT without the courts’ review and approval. If you die or become incapacitated without a will or trust that names your preferred guardian, the court could appoint someone other than the person you want to raise your child!
There will be a court proceeding to determine who will be named the guardian of your child’s person and property. If your child is under the age of 18 and is named as the beneficiary of your insurance policy or other accounts, the court will not allow them to directly inherit the proceeds. The court will name a legal guardian of property to manage what you’ve left for your kids. The guardian of the property will make periodic reports to the court on how they are managing the affairs of your child.
One of the biggest reasons for taking care of your estate planning now, is to avoid probate later. Avoiding probate means avoiding attorneys, judges, courts, and the state sticking their noses into your family affairs.⠀

This year I had a chance to listen to the story of Melissa Knoll from @lifehappens. She and her family was dealt a heavy hand when her husband was diagnosed with cancer. But because they had the proper financial structures in place, it gave her the financial protection and the assistance she needed when her husband passed away.

Gezellig! Gisteren waren we op bezoek bij het team van @estateplan.nl , dat bijna drie weken geleden verhuisde van Dam 77 naar Dam 55.
Het pand kenden we al een beetje, omdat we er al eens op bezoek waren bij @urban.heroes , maar EstatePlan heeft er natuurlijk wel een eigen draai aan gegeven. En Alex de Bakker nam ons ook even mee naar de kelder: die hadden we nog niét eerder gezien.
