Why is it important to work with a lawyer that predominately focuses on Real Estate Law? In my experience I have foreseen countless issues that come up, sometimes common and some highly unlikely but still possible. Highly problematic issues include situations pertaining to the Real Property Report. These issues can arise when the Real Property Report is ordered after a sale and the seller was unaware of the non-compliance, encorachments or other defects . I have dealt with numerous issues such as a gas line underneath a garage; a retaining wall encroaching on city property; a bomb shelter built under a garage that became what the seller thought at first to be a sink hole; all the way to sheds and where they ‘should’ be located. There is vast majority of these nuisances but we are regulated (pursuant to the standard form AREA contract) to offer a buyer a compliant Real Property Report (unless otherwise agreed at time of contractual acceptance) When you hire Shane, a lawyer , from an office that sees over 1000 closings per year this speaks to experience with Real property Reports, how to navigate through the difficult yet necessary repercussions of non-compliance and non-conformance so that both parties can reach a fair conclusion and a sale can complete. Do you need a will? Some of us feel we don’t have a big estate or don’t have a complicated enough life to warrant signing a Will. If you are over age 18 and own anything, even a small bank account or a collection of baseball cards, you need a Will. And estate planning is not just about the Will. There are other documents involved, documents that affect you in the here and now. Through a durable power of attorney, you can authorize a trusted agent to act on your behalf if necessary. Your medical power of attorney provides for necessary communication between your trusted agent and medical providers if you are not able to speak for yourself. Other documents you may need include an advanced directive, trusts, and business succession plans. Wills provide guidance to your family and representatives. So, even if you think you don’t need a Will, remember that your family does. 🧾

Here is why you should include beneficiary designations in your estate planning: When beneficiary designations are not in sync with estate planning, unintended imbalances may happen. A well-meaning person might write a Will, or create a Revocable Living Trust, dividing their assets according to what they are worth at the time, not accounting for fluctuations in value. Testators may change beneficiary designations over the years but fail to change their Wills and trusts. Accounts may be opened and closed after a Will has been signed or a trust established. Heirs may pass away or become estranged but are never removed from beneficiary designations. 🧾
